Peru Seeks To Jail Expelled Foreigners Who Return to Its Territory

The Boluarte regime proposes amending the Penal Code to penalize foreigners who violate expulsion orders.

On Thursday, Justice and Human Rights Minister Eduardo Arana announced that President Dina Boluarte’s government will submit a bill to imprison foreigners who illegally re-enter the country after being expelled.

The measure, which was analyzed during the Cabinet session held last Wednesday, proposes amending the Peruvian Penal Code to penalize foreigners who violate expulsion orders.

“Currently, what happens is that a foreigner subject to an administrative procedure is taken to the border and then re-enters through another point,” Arana said.

“We have even seen cases where a foreigner can illegally enter two, three, four, or even five times, mocking the authorities,” he added.

In this regard, the Executive’s proposal, which must be debated and eventually approved by Congress, seeks to allow the detention and imprisonment of expelled foreigners under a sentence resulting from an administrative or criminal process.

Arana also stated that the Boluarte administration hopes the proposal will be approved soon by the full Congress, which will resume its session in March.

On Wednesday, the Justice and Human Rights minister announced the possibility of Peru leaving the Inter-American Court of Human Rights (IACHR), in the context of a series of hearings aimed at gathering opinions on the application of the death penalty for rapists.
